Terms and Conditions (Zambia)
These Terms & Conditions ("Terms") govern your use of the PRIS Africa app, closed-loop Fuel Card, and loyalty program in Zambia as operated by Puma Energy Zambia Plc (Puma, we, us or our). By creating an account or using PRIS, you accept these Terms.
By selecting "I accept", creating an Account or using PRIS after being given a reasonable opportunity to review, save and reproduce these Terms, you agree to be bound by them. If you do not agree, do not create an Account or use PRIS.
IMPORTANT: PRIS is a loyalty program only. PRIS does not receive or hold subscriber funds and does not provide a wallet, stored-value account, payment service, deposit, credit facility or electronic money.
1. Definitions
- "Account" means the individual PRIS account registered to a Subscriber.
- "PRIS" means the Puma Energy's mobile app, closed-loop Fuel Card, and loyalty program in Zambia.
- "Fuel Card" means a stored-value facility usable only at participating Puma Energy service stations in Zambia.
- "Points" means loyalty points earned on qualifying purchases and redeemable per the prevailing rates.
- "QR Payments" means a payment method using QR codes to deduct funds from your Fuel Card balance at participating locations.
- "PIN" means a confidential code required for redemption and certain account actions.
- "Reward" means a good, service, discount, voucher or other benefit available in exchange for Points.
- "Subscriber" or you mean the individual who registers and uses an Account.
2. Eligibility, Registration and Account
- You must be 18 years old and above and legally capable of entering a contract. A parent or legal guardian may consent to use PRIS on behalf of a child but may not register an Account in the child's name.
- You must provide accurate, complete and current information and keep your contact details up to date.
- You are responsible for all activities under your account.
- Accounts inactive for 12 consecutive months may be subject to closure, and any remaining Fuel Card balance or Points may be forfeited.
- Puma reserves the right to refuse registration where the eligibility requirements are not met.
3. Fuel Card (Closed‑Loop) & QR Payments
- The Fuel Card is closed‑loop and may only be used at participating Puma Energy stations in Zambia.
- Fuel Card value and Points are not legal tender, cannot be bought or sold, are non‑transferable (except via enabled in‑app features), and cannot be redeemed for cash.
- QR code payments deduct your Fuel Card balance instantly; please review amounts before confirming.
- We may place reasonable limits on top‑ups, balance, and daily spend to manage risk and comply with law.
- The Fuel Card and your account are not credit facilities.
- All Fuel Card balances and transactions are denominated in Zambian Kwacha (ZMW) unless otherwise stated.
- Fuel Card balances do not accrue interest.
4. Family Sharing & Security
- Family sharing is permitted but entirely at your risk. Only share access with trusted persons.
- Keep your PIN secure. You are responsible for transactions performed using your PIN.
- Notify us immediately via prisafrica@pumaenergy.freshdesk.com if you suspect unauthorised use; we may suspend or block the account while we investigate.
- The primary account holder assumes full responsibility for all transactions and activities conducted by any person granted access through Family Sharing features.
5. Points: Earning, Redemption, and Expiry
- You earn Points on qualifying purchases and promotions as communicated from time to time.
- Redemption requires a valid PIN. We may vary the items eligible for redemption and the number of Points required.
- Redemption values (points to benefit) may change without prior notice. The current rates are always available on the PRIS website/app.
- Unless stated otherwise, Points expire 12 months after issuance. Expired Points cannot be reinstated.
- Some rewards or benefits may be supplied by third party vendors, partners or service providers.
- Points are non-transferable except as permitted by in-app features and hold no cash value. Points cannot be purchased or sold.
6. Fees and Statements
- We do not currently charge account maintenance fees. We may introduce reasonable fees in the future, and will publish changes on the PRIS website/app.
- You can view recent transactions and Points activity in the app. Please report discrepancies within 30 days.
- Any introduction of new fees or changes to existing fees will be communicated to users at least 30 days prior to implementation through the PRIS Africa App or website.
7. Prohibited Uses
You must not use PRIS for:
- Illegal, fraudulent, deceptive, or abusive conduct;
- Tampering with the app, Wallet, or redemption mechanisms;
- Selling or trading Wallet value or Points outside PRIS policies.
8. Errors, Reversals, and Fraud
- If an error occurs (e.g., technical failure, duplicate charge), notify us promptly. We may reverse or adjust transactions where appropriate.
- Transaction discrepancies or unauthorised activities must be reported within 30 days of the transaction date. Failure to report within this period may result in the denial of a claim.
- We may suspend, limit, or close accounts, and forfeit Points obtained through misuse, abuse or fraud.
9. Service Changes and Availability
- We may add, remove, or modify features, stations, or eligibility criteria.
- Service may be interrupted for maintenance, upgrades, or events beyond our control.
- Puma Energy reserves the right to discontinue the PRIS programme or any of its features at any time, with notice provided to users as practicable.
10. Security and Unauthorized Use
- You are always responsible for keeping your PIN safe. Unless Puma has been notified of unauthorized access, transactions authenticated using your PIN shall be deemed to have been authorized by you.
- Please inform us immediately if your PIN has been compromised or if you suspect unauthorized access.
- Users are advised to enable security features on their mobile devices, such as biometric authentication and screen locks, to prevent unauthorized access to PRIS Africa.
11. Liability
- To the extent permitted by law, Puma is not liable for indirect or consequential loss, loss of profit, or loss arising from unauthorized use where you shared your PIN or failed to secure your device.
- Nothing in these Terms excludes liability for gross negligence, willful misconduct, or liability that cannot be excluded under Zambian law.
12. Indemnity
You agree to indemnify, defend, and hold harmless Puma, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your: (a) breach of these Terms; (b) misuse of PRIS; or (c) any unlawful or negligent act or omission related to your use of PRIS. This indemnity is to the extent permitted by Zambian law.
13. Privacy
Your data will be used for administering the PRIS program and sending communications. Your use of PRIS is also governed by the PRIS Privacy Policy (Zambia). Please review it carefully.
Personal data may be shared with third-party reward providers solely for fulfilling rewards, in accordance with the PRIS Privacy Policy and Data Protection Act No. 3 of 2021.
14. Intellectual Property
All trademarks, logos, and content in PRIS are owned by Puma or its licensors. You receive a limited, revocable, non-exclusive, non-transferable licence to use PRIS for personal, lawful purposes. You must not reverse-engineer, decompile, or disassemble the app except to the extent permitted by law.
15. Disclaimers
- The PRIS website/app may include links to third party websites, apps and content. You choose to access these at your own risk.
- Puma Energy does not endorse or assume responsibility for third-party content, privacy policies, or practices.
- We do not control the quality, safety or legality of third-party goods and services offered through the PRIS programme.
- All third-party rewards are subject to the supplier's own terms and conditions, and redemption may require you to interact directly with the third party.
- We are not responsible for loss, damage or disputes relating to third party rewards, and your remedies (if any) must be sought from the third-party provider.
- Points and rewards are subject to availability and system functionality.
- We are not liable for technical glitches, errors, or disruptions unless caused by intentional or gross negligence.
- All content in the app, on our website, or in promotional materials (including information about rewards, offers, and partner services) is provided for general information purposes only.
- While we aim to ensure accuracy, we do not guarantee that content is error-free, current, or complete.
- We reserve the right to correct errors, update information, or withdraw rewards without prior notice.
- You are responsible for verifying details (including reward eligibility, expiry dates, and partner terms) before making decisions based on the content provided.
- We are not liable for any loss or damage arising from reliance on content displayed in the app, website, or related communications.
16. Amendments
- We may update these Terms from time to time for legitimate legal, regulatory, security, operational or commercial reasons.
- Where an amendment materially and adversely affects Members, Puma Energy will notify the members via the app or website within reasonable time. The notice will include a summary of the changes, the effective date and, where applicable, any action required by the Member.
- No amendment shall retrospectively remove legitimately accrued Points or reduce a Reward that has already been confirmed, except where necessary to correct fraud, a manifest error or where required by applicable law.
- The latest version of the Terms will always be available on the PRIS website/app.
- Continued use of PRIS after notice of an amendment constitutes acceptance of the amended Terms, to the extent permitted by applicable law. Where applicable law requires express consent, including for the introduction of new fees or material changes requiring specific consent, Puma Energy will obtain such consent before the amendment takes effect.
17. Termination
- You may request closure of your account at any time via the app or by contacting support.
- We may suspend or terminate your account for breach of these Terms, fraud, or unlawful activity. We may also terminate where required by law or regulators. Upon termination, any remaining Fuel Card balance or Points will be forfeited, except where prohibited by law.
18. Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia.
- The courts of the Republic of Zambia shall have exclusive jurisdiction in respect of any dispute, controversy or claim that shall arise out of or in connection with these Terms.
19. Dispute Resolution
- The Parties shall use their reasonable endeavors to resolve amicably any dispute, controversy or claim arising out of or in connection with this Terms through consultation and good faith negotiations.
- Where a dispute cannot be resolved amicably within thirty (30) days of written notice of the dispute, either Party may refer the dispute to the appropriate authority or court of competent jurisdiction in accordance with the applicable laws of Zambia.
20. Force Majeure
Puma Energy shall not be liable for any delay or failure to perform its obligations resulting from events beyond its reasonable control including power failures, telecommunications outages, cyber incidents, acts of God, labor disputes or governmental action.
